In a recent court decision, Avant Homes (Scotland) Ltd was fined £333,000 after an unfortunate accident led to the death of an HGV driver. The incident occurred in April 2017 at Shott Farm in High Blantyre, where concrete blocks fell during unloading, tragically killing Conor Joseph Morgan, aged 45.
The Health and Safety Executive (HSE) reported that the mishap involved the use of an excavator equipped with pallet fork attachments, which were not ideally suited for the task. The forks extended beyond the pallet’s width, inadvertently making contact with a second pallet, leading to the fatal fall of concrete blocks onto Mr Morgan. This detail elucidates the inadequate safety mechanisms in place at the site overseen by Avant Homes.
Furthermore, the HSE’s investigation revealed that the principal contractor, Avant Homes, failed to enforce a secure unloading procedure for delivery vehicles, a grave oversight that contributed to the disaster. Similarly, Regen Waste Ltd, Mr Morgan’s employer, was found guilty of not conducting a proper risk assessment for drivers working on remote sites, resulting in a £23,000 fine.
Graeme McMinn, HSE principal inspector, stated emphatically that the incident was entirely preventable with proper safety systems. ‘This was a tragic and wholly avoidable incident, caused by a failure of the principal contractor to implement a safe system of work.’ The HSE warned that they will ‘not hesitate to take appropriate enforcement action against those that fall below the required standards.’
