Groundworks contractor Van Elle has been fined for a fatal safety violation involving a piling rig mast.

On 21st January 2021, a concerning safety incident occurred at the Hallmeadow development in Annan, Scotland, leading to the tragic death of a 52-year-old HGV driver, Gary Dobinson. Employed by a different company, Dobinson was at the site to facilitate the transportation of a piling rig owned by Van Elle. During the operation, as the rig’s mast was being lowered, it unexpectedly collapsed, striking Dobinson and resulting in fatal injuries. Despite swift intervention by site workers and emergency services, Dobinson could not be saved.
The subsequent investigation, carried out by Police Scotland and the Health & Safety Executive (HSE), highlighted severe deficiencies in the maintenance of the piling rig. A critical component, the securing lug for one of the mast’s retaining pins, was found to be significantly corroded. The failure of this part allowed the pin to displace, causing the mast’s catastrophic collapse.
Van Elle Limited, based in Kirkby-in-Ashfield, Nottinghamshire, faced legal action for their apparent negligence. The company admitted liability under Regulation 5 of the Provision & Use of Work Equipment Regulations 1998, acknowledging their failure to ensure the rig was in a safe working condition. This admission led to a considerable penalty, with Dumfries Sheriff Court imposing a fine of £233,000 on 4th June 2024.
HSE inspector, James Caren, stressed the critical importance of maintaining work equipment. He stated, “All work equipment should be subject to suitable inspection and maintenance to ensure that it can be used without risk to the safety of those using it and those in the vicinity”. His comments underscored how construction machinery, which operates in challenging environments, necessitates diligent inspection and maintenance to avert safety hazards.
This incident serves as a stark reminder of the paramount importance of implementing robust safety measures. Effective inspection regimes are essential to prevent equipment defects from posing risks to both operators and bystanders at construction sites.
