The Brighton Magistrates Court also imposed an additional £12,500 in costs on the company, following revelations of extensive illegal dumping activities.
The investigation by the Environment Agency was initiated by an anonymous tip-off, uncovering that between June and November 2018, nearly 700 lorry-loads of waste, including glass, wood, and concrete, were dumped without approval. Rusper Leisure had initially secured planning permission to elevate an embankment at the golf course but was only permitted to use clean soil, a condition that was grossly violated.
In their pursuit for accountability, the agency found that despite knowing the legal requirement, Christopher Cook merely queried if the dumping site was legal but failed to make necessary verifications. Similarly, Duncan Bell, from Bell and Sons Construction, neglected to confirm the site’s compliance with environmental permits, relying solely on planning permissions reportedly secured by the golf club.
Rusper Leisure, responsible for the jurisdiction of the golf course, was fined £2,000 plus £3,000 in costs for operating without the requisite environmental permit. They were inadequately prepared to ensure that waste regulations, particularly regarding hazardous materials, were adhered to, resulting in substantial mismanage of documentation and process.
