The incident occurred when Kenneth Armitage, aged 81, fell through an unguarded hole in the floor of his home, created during the conversion of his bathroom into a wet room. The unfortunate accident came to light when his son-in-law discovered him in the kitchen downstairs, a day following the fall.
The Health and Safety Executive (HSE) reported that Cooper and Westgate had not secured the hole left after removing floorboards to access pipework, a critical lapse attributed to the lack of employee training. The company further neglected to conduct a thorough risk assessment and failed to draft a method statement for the work, leading to the breach of Sections 2(1) and 3(1) of the Health and Safety at Work etc. Act 1974. This dereliction of duty was confirmed by the ruling of the Leeds Magistrates Court on 17 September.
As a penalty, Cooper and Westgate not only faces a £150,000 fine but must also pay £50,000 in associated legal costs. Yolande Burns-Sleightholme, the HSE health and safety inspector, emphasised the necessity for employers to anticipate risks inherent in work at height scenarios, especially when creating floor openings in residential properties.
