Commission Recovery Limited (CRL), Marks & Clerk LLP (M&C), and Long Acre Renewals have reached a settlement regarding litigation over payments made by IP renewals service provider CPA Global, now operating under the name Clarivate, between March 14, 2009, and February 1, 2018.
A trial on certain issues was previously scheduled for January 2025. However, M&C and Long Acre Renewals have denied any wrongdoing, and without admitting liability, they agreed to pay a percentage of CPA Global payments to specific clients as part of the settlement. This agreement also includes a specified payment to CRL for its costs, expenses, and services, with the proceedings now stayed.
Peter Rouse, director of Commission Recovery Limited and representative claimant, commented on the settlement, saying, “I believe that the settlement provides the best achievable outcome for class members. Further litigation would serve only to reduce the potential returns for class members.”
A Marks & Clerk spokesperson added, “We are glad that these proceedings have been settled so that we can concentrate on our core business and services to clients. We do not accept that the claims were well-founded, but are pleased that the litigation has been brought to an end on agreed terms.”
