The situation had gained substantial attention following a feature on BBC’s Panorama in July 2016. Tony Carter, Managing Director of HT Legal Ltd, remarked on this milestone: “This marks a significant milestone after three years of diligent efforts.”
The path to this outcome was arduous, involving an 18-month investigation by the FSCS, which initially rejected all claims. Nevertheless, HT Legal Ltd persisted, compelling a review of the decision. The challenge was to demonstrate that The Resort Group operated as an Unregulated Collective Investment Scheme. In January 2024, their efforts bore fruit as the FSCS agreed to uphold the initial client claim. Crucially, even though this appeal incurred additional financial and time commitments, HT Legal chose not to levy extra charges on their clients.
Tony Carter added a critical perspective regarding other firms’ approaches: “We know that some of our competitors have chosen to take more aggressive action which has resulted in their clients having to pay additional charges. We always believed we would see a positive outcome and wanted to remain focused on our clients getting the best financial result.” This underlines the firm’s ethos of prioritising the client’s best interests above financial gain.
The broader landscape of this issue remains challenging, with approximately 300 clients yet to receive resolutions. These individuals are confronting claims that vary from £5,000 to £300,000. However, due to the FSCS’s compensation cap at £85,000 per claim, many clients may still bear significant financial losses.
