A recent court ruling has seen a groundworks firm fined £75,000 following the death of a site worker in Glasgow. The worker, Derek Caddie, aged 44, tragically lost his life when a trench wall collapsed during a housing project on 25 November 2019. Under the control of Carrig Construction Services Ltd, Caddie was working with a colleague on repairing damaged and leaking pipework at the time of the accident. Although his colleague escaped unharmed, Caddie was trapped in the soil from the neck down and succumbed to his injuries three days later in hospital.
The Health and Safety Executive (HSE) launched an investigation into the incident, which revealed significant oversights. The collapse was primarily attributed to inadequate support for the trench’s vertical walls. Furthermore, Carrig Construction Services Ltd failed to recognise the dangers present and did not implement necessary safety measures. There was a blatant oversight in ensuring that workers engaged in excavation tasks were adequately trained, with none receiving formal education in safe excavation practices.
In legal proceedings, Carrig Construction Services Ltd, based in Lochwinnoch, Argyll, admitted guilt to breaches under Section 2(1) and Section 3(1) of the Health and Safety at Work etc Act 1974. It was conclusively found that the company had not taken “practicable steps” to ensure the safety of the workers in the excavation area. As a result, the firm was fined £75,000 at Glasgow Sheriff Court.
HSE principal inspector Graeme McMinn stated, “This was a tragic and wholly avoidable accident, caused by the failure of Carrig Construction Services Ltd to put in place measures to control the risk of the sides of the excavation collapsing.” His words underscore the critical importance of adhering to safety regulations to prevent such unfortunate events.
