The legal battle was spearheaded by Paul Magee, the head of property litigation at the firm, centred on a substantial six-figure claim of negligence against another legal entity. The original law firm, which had previously represented Cathcart, failed to identify that the land acquired by Cathcart was landlocked, thus unsuitable for development—a failing that was only discovered after planning permissions and architectural plans were established.
Craig Cathcart, well-regarded for his contributions on the field as a centre-back for teams such as Blackpool and Watford, not to mention his successes representing Northern Ireland with 73 caps, found himself in a challenging situation due to oversights during a conveyancing process. This particular oversight, as noted by Paul Magee, was a matter of serious concern. “The fact that such a critical detail was overlooked is deeply concerning,” Magee stated, mentioning that a basic examination using online mapping tools would have exposed the lack of physical access to the land. “This was a fundamental error that had severe consequences for our client,” he added.
Despite significant resistance from the insurers of the accused negligent law firm, who originally contested liability, a settlement nearing £500,000 was arrived at. This financial resolution was comprehensive, accounting for both the damages encountered by Cathcart and the legal expenses incurred throughout the proceedings. Such outcomes underscore the pivotal importance of detailed due diligence in property transactions, as Magee reflected on the case’s outcome. He noted that although litigation can be daunting, it is sometimes necessary to uphold justice. “This case is a stark reminder of the importance of thorough due diligence in property transactions,” he remarked.
